This case involved a U.S. citizen who is a direct family member of Chuck Palahniuk, the acclaimed American author known for the novel Fight Club. The applicant approached Intermarium Law Firm with the goal of acquiring Ukrainian citizenship based on territorial origin, citing her ancestral roots in the Ternopil region of western Ukraine. The client’s genealogical history indicated a direct national origin from individuals born in what is now Ternopil region at Western Ukraine during the time of the Austro-Hungarian Empire. Her ancestors had emigrated to the United States in the early 20th century. The citizenship application process therefore hinged on legally validating this territorial connection through historic and legal documentation—much of which spanned continents and decades.
Ukrainian legislation provides for citizenship by origin, allowing individuals to claim citizenship if they can establish their descent from someone who was born or on the territory of Ukraine (including Soviet Ukraine, Russian Empire, Austro-Hungarian Empire, Poland between world wars, etc.). However, the burden of proof in such cases is substantial.
This necessitated a multidisciplinary legal approach encompassing genealogical verification, document legalisation, archival research, and cross-border regulatory compliance in order to find out enough proofs of Ukrainian origin.
